An account is optional and lets your picks follow you across devices. We collect only what we need to run the site, and we never sell your information. These Terms of Service ("Terms") form a legally binding agreement between you and Condensation Farms, Inc. ("Condensation Farms," "we," "us," or "our"), which owns and operates The Sports Farmer, including the website at sportsfarmer.com (and its earlier address, sports-farmer.web.app), its pick'em and account features, and related services (collectively, the "Service").
By accessing or using the Service, you agree to these Terms. If you create an account, you also confirm your acceptance when you create it. If you do not agree to these Terms in their entirety, you may not access or use the Service.
We may revise these Terms from time to time. When we do, we will update the version marker at the top of this page. Your continued use of the Service after a revision takes effect constitutes your acceptance of the revised Terms. If a revision is material, we will make reasonable efforts to call attention to it on the Service.
You must be at least eighteen (18) years old, or the age of legal majority in your jurisdiction if greater, to use the Service. Because the Service displays sports betting market information, it is intended for adults only. By using the Service, you represent and warrant that you meet this requirement. The Service is not directed to, and we do not knowingly permit use by, anyone under the age of 18. If we learn that a person under 18 has created an account or provided us with information, we will take steps to delete that information and terminate the associated access.
You further represent that you have the legal capacity to enter into a binding contract, that your use of the Service does not violate any law applicable to you, and that any information you provide to us is accurate.

We may add, modify, or remove features of the Service at any time, with or without notice, and we do not guarantee that any feature, report, or sport will continue to be offered. The Service may be unavailable from time to time for maintenance, data outages, or other reasons.
The Sports Farmer is a data and entertainment service only. It is not a gambling, betting, wagering, or gaming service of any kind.
You cannot place a bet, wager, or stake of any kind through the Service, and you cannot deposit, risk, win, or withdraw money or anything of value. The pick'em feature is offered for personal interest and entertainment only. Picks, records, and any other results shown on the Service have no monetary value, cannot be exchanged for money, prizes, credits, or anything else of value, and do not entitle you to any reward. We do not run contests, sweepstakes, or prize competitions through the Service.
Nothing on the Service is a recommendation, prediction, "pick," or tip about the outcome of any sporting event, or advice about whether, how, or how much to bet. Market lines (point spreads, totals, and implied scores) are shown only as information about how the betting market viewed a game at a point in time. The "market favorite" preset in the pick'em feature reflects that market information, not our opinion. The Impact Injury Score and all other statistics are estimates based on public data and our own assumptions; they are not predictions of any game's outcome. Nothing on the Service is financial, legal, or other professional advice.
Any decision you make, including any decision to place a wager with a third party, is yours alone and is made at your own risk. Sports betting is legal only in certain jurisdictions and only for people of legal age, and it is your responsibility to know and follow the laws that apply to you. We are not a sportsbook, bookmaker, tipster, or handicapping service; we are not affiliated with, sponsored by, or paid by any sportsbook or betting operator; and we do not accept advertising from them.

You can read the Service and make picks without an account. Without an account, your picks are stored only in your web browser on your device, and they may be lost if you clear your browser data, use a different browser or device, or use private browsing.
If you create an account, you may sign in with an email address and password, or with your Google account. If you use an email address and password, you are responsible for choosing a secure password, keeping it confidential, and for all activity under your account. If you sign in with Google, your use of that sign-in is also subject to Google's terms. You are responsible for the security of the email account or Google account associated with your Service account, including any consequences of someone else gaining access to it. Password-reset messages are sent to the email address on your account.
You agree to provide an email address you control and to keep it current. Signing in confirms access to an email or Google account; it does not verify your identity or age beyond your representation in Section 2.
When you make a pick, the Service records the team you chose and, if you are signed in, the time the pick was saved according to our servers. A pick counts toward your record only if it was saved before the game's scheduled start. Picks set by the Service's automatic presets or "Autopick" feature are recorded as such and count the same as picks you make yourself.
We use reasonable efforts to preserve your picks and records, but we do not guarantee that they will be stored indefinitely or without error, and we may reset, correct, or remove picks or records (for example, to fix a data error, a schedule change, or a game that is postponed or canceled). Records reflect final results as published in our data sources, which may be corrected after the fact.

We may investigate and take appropriate action against anyone who, in our sole discretion, violates this Section, including suspending or terminating access and reporting conduct to law enforcement where appropriate.
The Service is built from third-party and public data sources, which as of the Effective Date include nflverse, ESPN, the sportsdataverse project, the National Weather Service, and the official league injury reports. These sources can be incomplete, delayed, or wrong, and they can change after we publish. Market lines change frequently and may differ from the lines offered by any particular sportsbook. Injury statuses and weather can change up to the start of a game.
Reports are compiled by automated software, and some written summaries are drafted with the help of artificial intelligence tools and checked automatically against the underlying data. Despite those checks, the Service may contain errors or omissions. You should independently verify any information before relying on it.
The Sports Farmer is not affiliated with, endorsed by, or sponsored by the National Football League, the National Basketball Association, any other league, any team, or any data provider. Team and league names are used only to identify them, and all trademarks belong to their respective owners. Links to third-party websites, such as player pages, are provided for convenience, and we are not responsible for their content.
If you create an account, we collect and store: your email address; your name and profile information as provided by Google, if you sign in with Google; an internal account identifier; and your picks, including the team chosen, whether it was set manually or automatically, and the time it was saved. Your password, if you use one, is handled by our authentication provider and is never visible to us. Whether or not you have an account, the Service stores your picks and display preferences (such as light or dark mode) in your own browser's local storage.
We use this information only to operate and improve the Service, to keep your picks and records, to communicate with you about your account (for example, password resets), and as otherwise described in these Terms. We do not show advertising, we do not sell your personal information, and we do not share it except with the service providers in Section 10 as needed for them to run the Service, where required by law, to protect our rights, or in connection with a merger, acquisition, or sale of assets.
You may reset your picks at any time from the Service. To request deletion of your account and associated data, email us from the address on your account using the contact information in Section 20, and we will make commercially reasonable efforts to honor legitimate requests, subject to our legal and record-keeping obligations.
The Service relies on infrastructure and services provided by third parties, including Google Firebase and Google Cloud Platform (hosting, database, and authentication), Google (optional sign-in), the data sources described in Section 8, and one or more artificial intelligence providers used to draft report text. Your personal information is not sent to artificial intelligence providers; they receive only sports data. Your use of the Service is also subject to the applicable terms and privacy policies of these providers. We are not responsible for the acts, omissions, availability, or security practices of any third-party service, and any interruption, error, or data loss attributable to one is not a breach of these Terms by us.
The Service, including its software, design, branding, logos, reports, written analysis, charts, and our selection, arrangement, and compilation of data, is owned by Condensation Farms or its licensors and is protected by intellectual property laws. Underlying factual data (such as game scores and statistics) is not claimed as ours. Except for the limited right to use the Service for your personal, non-commercial use as permitted by these Terms, no right, title, or interest in the Service is transferred to you. You may share links to the Service and the "Share my week" summary of your own results. "The Sports Farmer" and its logos are trademarks of Condensation Farms (or, prior to any registration, are claimed as common-law trademarks), and you may not use them without our prior written consent.
The Service is currently provided free of charge. We may introduce paid features or subscriptions in the future. If we do, the price, billing terms, and any related conditions will be presented to you before you are charged, and you will not be charged without your affirmative agreement. Any paid feature will remain subject to Section 4: no paid feature will involve wagering or prizes.
We may suspend or terminate your access to the Service or your account at any time, with or without cause and with or without notice, including for actual or suspected violation of these Terms. We may also discontinue the Service, or any sport, report, or feature, at any time. Upon termination, your right to use the Service immediately ceases. Sections 4, 7, 8, 11, and 14 through 19 survive any termination.
You may stop using the Service at any time, and you may request deletion of your account as described in Section 9.
THE SERVICE AND ALL DATA, REPORTS, STATISTICS, ESTIMATES, MARKET LINES, AND OTHER CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that any data or content will be accurate, complete, or current; that any defect will be corrected; or that the Service will meet your requirements. Your use of the Service, and any decision you make based on it, is at your sole risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONDENSATION FARMS OR ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, INCLUDING ANY WAGERING OR GAMBLING LOSSES OR ANY LOSS RESULTING FROM RELIANCE ON ANY DATA OR CONTENT ON THE SERVICE, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, REGARDLESS OF THE LEGAL THEORY ON WHICH SUCH DAMAGES ARE CLAIMED, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) TWENTY-FIVE DOLLARS ($25.00) USD.
These limitations apply regardless of the failure of essential purpose of any limited remedy and are a fundamental basis of the bargain between you and us. Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above limitations may not apply to you.
You agree to defend, indemnify, and hold harmless Condensation Farms and its owners, officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of, or access to, the Service; (b) any decision you make or action you take based on the Service, including any wager placed with a third party; (c) your violation of any provision of these Terms; or (d) your violation of any law or any third-party right.
This section affects your legal rights. Please read it carefully.
You and Condensation Farms agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. This agreement to arbitrate is intended to be interpreted broadly and encompasses all Disputes based on any legal theory.
The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall take place in Dane County, Wisconsin, or, at your election, may be conducted by telephone or videoconference, or based solely on written submissions where the amount in controversy is under $10,000. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND CONDENSATION FARMS EACH AGREE THAT ANY PROCEEDING TO RESOLVE A DISPUTE WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND CONDENSATION FARMS EACH WAIVE ANY RIGHT TO A JURY TRIAL. If any part of this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request for relief (and only that claim or request) shall be severed and may be brought in court, with the remainder of this arbitration agreement remaining in full force.
You may opt out of this arbitration agreement by sending notice to the email address in Section 20 within thirty (30) days of first using the Service or creating an account. Your notice must include your name and a clear statement that you wish to opt out of arbitration. If you opt out, neither you nor Condensation Farms will be required to arbitrate Disputes, but all other provisions of these Terms, including the class action waiver in Section 17.3, remain in effect to the fullest extent permitted by law.
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws principles, except to the extent preempted by the Federal Arbitration Act. For any Dispute not subject to arbitration under Section 17 (including any claim properly brought in small claims court, or following a valid opt-out under Section 17.4), you agree to the exclusive jurisdiction and venue of the state and federal courts located in Dane County, Wisconsin.
These Terms, together with any policies referenced herein, constitute the entire agreement between you and Condensation Farms regarding the Service and supersede all prior agreements and understandings, whether written or oral.
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms shall not be deemed a waiver of that or any other provision.
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disaster, war, terrorism, labor disputes, internet or utility failures, data-source outages, or failures of our third-party service providers.
These Terms do not confer any rights or remedies on any person other than you and Condensation Farms.
Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and Condensation Farms.
